    A federal judge has limited the federal government’s ability to transfer or deport Oscar Belgal, the 28-year-old man shot by U.S. Immigration and Customs Enforcement (ICE) officers while his 5-year-old child was inside his vehicle in New York City.

    The court action followed a shooting on October 8 in the Marble Hill neighborhood, where Belgal was wounded during an attempted arrest. His child was in the back seat but was not physically injured.

    The case took a new turn on Friday, October 9, when federal judges considered emergency requests concerning Belgal’s detention and his ability to challenge the government’s actions in court.

    Judge J. Paul Oetken issued an order temporarily preventing authorities from deporting Belgal without further court approval. The order also restricted transfers outside designated federal court districts in New York and New Jersey.

    A separate hearing before U.S. District Judge John P. Cronan addressed Belgal’s emergency request for additional protection. The judge denied that separate request, leaving the earlier restrictions on deportation and transfer in place.

    Belgal’s legal challenge remains unresolved, and the court’s orders do not determine whether the shooting was justified or whether his detention is lawful.

    What Happened During the ICE Operation?

    The shooting occurred at approximately 4 p.m. Thursday near Marble Hill Avenue and West 225th Street.

    According to New York City Police Commissioner Jessica Tisch, federal officers approached Belgal’s vehicle as he was pulling into a parking space. At least one officer had a firearm drawn.

    Tisch said Belgal began moving the vehicle forward before an officer fired seven rounds. One bullet struck him in the neck, below his left ear.

    The Department of Homeland Security (DHS) offered a different account of the encounter. Officials said ICE agents were conducting a targeted operation to arrest Belgal and alleged that he used his vehicle to strike federal vehicles and attempted to drive toward officers.

    Homeland Security Secretary Markwayne Mullin said agents did not know a child was in the back seat when the shots were fired. He also accused Belgal of knowingly putting the child at risk while attempting to flee.

    The competing accounts have intensified questions about how the operation unfolded and whether the use of force was necessary. The circumstances surrounding the shooting remain under investigation.

    Newly Released Video Shows the Aftermath

    The New York Police Department released body-camera footage on Friday showing officers arriving at the scene after the shooting.

    The video shows Belgal handcuffed on the ground, surrounded by armed individuals wearing civilian clothing. One responding officer can be heard warning colleagues about a person carrying a gun as they approach.

    The footage captures the confusion in the moments after officers arrive. People at the scene call for medical assistance, while a woman can be heard shouting that Belgal had been shot.

    Responding officers subsequently move him into a vehicle and transport him for medical treatment.

    The NYPD said its officers were not involved in the federal enforcement operation. They responded after receiving a 911 call about a shooting.

    The released footage documents the aftermath but does not, by itself, settle the conflicting accounts of what happened immediately before the officer fired.

    Witness Iris Rosa said she rushed toward Belgal after hearing the gunshots. She recalled him expressing fear for his life and asking for help.

    The presence of a young child inside the vehicle has become a central concern for residents and public officials following the incident.

    Mayor Mamdani Criticizes ICE After Shooting

    New York City Mayor Zohran Mamdani condemned the shooting and called for ICE to leave the city.

    Mamdani said he spent approximately two hours speaking with President Donald Trump and Homeland Security Secretary Markwayne Mullin in an effort to secure Belgal’s release. Those discussions did not result in his release.

    The mayor later confirmed that Belgal had been taken into federal custody from the hospital where he was receiving treatment.

    The incident also prompted protests outside the hospital Thursday night, where demonstrators gathered to demand accountability and challenge the federal agency’s enforcement tactics.

    Additional demonstrations were expected in Manhattan on Friday as anger over the shooting continued to grow.

    The dispute has also highlighted broader tensions between New York City officials and the Trump administration over cooperation with federal immigration authorities.

    Federal Officials Cite Belgal’s Criminal History

    DHS said Belgal, who is from the Dominican Republic, was the subject of a targeted enforcement operation because of his criminal history and alleged connections to the Trinitarios street gang.

    The agency cited a previous grand larceny conviction and prior arrests involving allegations of assault, robbery, drug possession and weapons offenses.

    Federal officials also criticized New York’s sanctuary policies, arguing that restrictions on cooperation with immigration authorities make arrests more difficult and potentially dangerous.

    However, allegations made by law enforcement officials are not the same as findings in the current legal proceedings. The circumstances of the shooting and the legality of Belgal’s detention remain separate issues before authorities and the courts.

    The incident has renewed debate over the tactics used during federal immigration arrests, particularly in residential neighborhoods where children and other bystanders may be present.

    What Happens Next in Belgal’s Case?

    Belgal’s attorneys have challenged his detention through a federal court petition, seeking judicial review of the government’s actions.

    The court’s existing order prevents his deportation without further judicial approval and places limits on where federal authorities can transfer him while the legal matter proceeds.

    A separate emergency request was denied during Friday’s proceedings, but that decision did not overturn the earlier restrictions on removal.

    Federal authorities have also faced questions about Belgal’s whereabouts following his transfer from the hospital. Officials initially declined to identify the facility where he was being held, while court proceedings focused on his location and the circumstances of his detention.

    The shooting is also subject to an investigation involving federal authorities. The available body-camera footage shows the aftermath, while questions about the moments leading up to the gunfire remain central to the dispute.

    For now, the legal proceedings will determine the next steps in Belgal’s detention challenge, while investigators continue examining the encounter that left him wounded and placed a child at the center of a contentious federal enforcement operation.
