    Rochester Mother and Boyfriend Charged After Developmentally Disabled Son Dies

    A Rochester woman and her boyfriend are accused of restraining and severely neglecting her 33-year-old son before his death, with investigators also examining the use of his government benefits.

    A Rochester, New York, investigation that began with a 911 call over an unresponsive man has led to murder and kidnapping charges against his mother and her boyfriend.

    Timothy Green, 33, was found dead inside an apartment on St. Paul Street on Feb. 17, 2026. Police said he was found without clothing, weighed about 88 pounds and had bruising around his wrists and ankles. He was pronounced dead at the scene.

    Andrea Livers, 58, Green’s mother, and her boyfriend, Lancysa Harris, 42, were arrested in September and each faces charges of second-degree murder, first-degree kidnapping and endangering the welfare of an incompetent or physically disabled person. The charges are allegations, and the case remains pending.

    Investigation uncovered evidence of possible restraint

    The circumstances surrounding Green’s death became clearer months after his death.

    An initial autopsy did not establish a cause of death. The Monroe County Medical Examiner’s Office later classified the death as a homicide and determined that Green died from severe dehydration and failure to thrive in a setting of probable restraint.

    During a search of the apartment, investigators reported finding handcuffs, barbells and other home-gym weights. Police also noted an unusual amount of cleaning supplies and said they did not find clothing, bedding or other personal belongings that appeared to belong to Green.

    Investigators also reviewed surveillance footage covering the 45 days before Green was found dead. According to police, the footage did not show Green entering or leaving the residence during that period, while Livers and Harris were seen coming and going.

    Police allege that Green was physically restrained and deprived of adequate food and water. Investigators also said cellphone evidence supported the conclusion that he had likely been restrained.

    Green’s benefits are part of the investigation

    The investigation has also raised questions about Green’s Social Security and SNAP benefits.

    Harris became the designated payee for Green’s benefits in 2024. Around that period, police said Green stopped attending medical appointments and other scheduled activities.

    Authorities allege that SNAP benefits intended for Green were used by Livers and Harris rather than for his care. A federal investigation into the benefits is ongoing, and additional charges could follow depending on the findings.

    The county is also reviewing records related to whether Adult Protective Services had previously been involved with Green. Officials said that review is ongoing.

    Green moved to Rochester after his father’s death

    Green spent most of his life in Tuscaloosa, Alabama, where he lived with his father and stepmother. His father, who had full custody, died in 2023.

    After his father’s death, Green moved to Rochester in an effort to reconnect with his biological mother. Police said Livers had lost custody of him when he was very young because of previous abuse-related issues.

    Green had developmental disabilities and relied on others for some aspects of daily life, although police said he was physically capable of caring for himself.

    His family has since spoken about him as someone with a gentle personality. His stepmother, Marbrey Green, described him as sweet and said he enjoyed cartoons and talking about Greek mythology. The family is cooperating with investigators as the case moves forward.

    Police believe Green died weeks before he was found

    Investigators believe Green died sometime between Jan. 19 and Feb. 17.

    The length of the alleged abuse remains under investigation, but police have said they believe it occurred for at least several weeks. The evidence gathered so far has led authorities to focus on the period when Green was living with Livers and Harris in Rochester.

    Livers and Harris have denied neither the charges nor the allegations in a public statement cited in the available reporting, and their explanations to investigators were described by police as inconsistent. Both are due back in court later this month as the criminal case continues.

    The investigation remains active, particularly around the circumstances of Green’s death and the handling of his government benefits. Further findings could determine whether additional charges are filed.
