A late-night welfare check at a North Carolina home turned into a chaotic confrontation after officers reportedly discovered extensive damage, dangerous objects and four children who authorities say may have been at risk.

Gabriel Antonio Santos-Funes, 35, and Maria Valladares, 33, were arrested following the Oct. 21 incident at their residence in Mecklenburg County. Investigators allege that the couple resisted arrest and assaulted officers responding to a neighbor’s report of disturbing activity inside the home.

Both parents face four misdemeanor counts of child abuse, along with charges of resisting a public officer and assault on a government official. Valladares also faces an additional charge of malicious conduct by a prisoner, stemming from allegations that she spat at officers and inside a police vehicle.

The case involves four children, ages 14, 11, 5 and 3. According to the police affidavit, the responding officers encountered conditions inside the residence that raised immediate concerns about the children’s safety.

    Neighbor’s call prompts police response

Officers were dispatched at approximately 9:37 p.m. on Oct. 21 after a neighbor reported loud screaming, unusual activity and what appeared to be burning inside the home.

The caller also expressed concern that the family might be performing rituals described as black magic. The neighbor reportedly told authorities that the children’s mother appeared to have dark bruising on her face.

These were allegations made by the caller, not independently established findings about what had happened before police arrived.

As officers approached the residence, they reportedly heard screaming and saw objects being thrown inside. The affidavit describes a troubling scene along the path to the front porch, where officers found live and spent .22-caliber cartridges, broken items and droplets of blood.

The situation became more concerning once officers entered the home.

Officers describe extensive damage inside the home

According to the affidavit, much of the home’s interior appeared to have been damaged. Furniture and decorations had been destroyed, while broken glass and other sharp objects were scattered throughout the residence.

Police also reported finding large knives, blowtorch-style lighters and other potentially dangerous items within easy reach.

The parents allegedly gave conflicting explanations for the condition of the house. They initially said they had been cleaning, but later claimed other people had entered the residence and caused the damage.

Investigators have not established through the allegations alone exactly how the damage occurred or what led to the reported disturbance.

During the encounter, officers said Santos-Funes began behaving erratically. According to the affidavit, he attempted to rub garlic on responding officers and a Bible. Valladares was described as speaking rapidly and becoming increasingly agitated.

The situation reportedly escalated further when Santos-Funes began spraying one of the children with cologne.

The affidavit describes the spraying as excessive, adding another concern to officers’ assessment of the children’s immediate surroundings.

Child reportedly tells officers she was scared

One of the most significant details in the police account involves a child who allegedly told officers she did not feel safe in the home.

According to the affidavit, Santos-Funes moved toward a large butcher knife on the kitchen table. Officers ordered him to move away from it.

During this moment, a child reportedly told police that she was not okay and was frightened to remain in the house.

That statement added urgency to an already tense encounter. Officers responding to reports involving children must assess not only whether a crime may have occurred but also whether anyone inside faces an immediate risk of injury.

The affidavit identifies all four children in the household as alleged victims in the child-abuse case. The publicly described allegations do not, by themselves, establish the full extent of any injuries or the precise circumstances each child experienced.

Garlic allegedly thrown at officers during arrest

The encounter escalated when officers attempted to take Santos-Funes into custody.

According to the affidavit, he allegedly threw cloves of garlic at an officer. When the officer moved to detain him, Valladares allegedly grabbed the officer around the neck.

Police said both parents resisted arrest and assaulted officers during the struggle.

Valladares was also accused of attempting to bite an officer on the leg while officers tried to handcuff Santos-Funes.

After she was taken outside toward police vehicles, she allegedly spat at officers and continued spitting inside one of the vehicles.

Those allegations form the basis of the additional charges reported against the couple, including Valladares’ charge of malicious conduct by a prisoner.

The affidavit describes a rapidly deteriorating situation in which officers were attempting to secure the scene while dealing with alleged physical resistance and concerns about the children.

    What the charges mean

Santos-Funes and Valladares were booked into the Mecklenburg County jail following the incident.

Both are charged with four counts of misdemeanor child abuse, with each count corresponding to an alleged victim. They also face charges related to resisting public officers and assaulting government officials.

In North Carolina, the specific legal consequences of a child-abuse charge depend on the statute charged and the circumstances prosecutors can establish. The classification of an offense can also depend on factors such as the nature of the alleged conduct and whether a child suffered injury.

The allegations in this case have not yet been proven in court. Prosecutors must establish the required elements of each charge, and the defendants have the right to contest the accusations.

Both parents are scheduled to appear in court again on Nov. 13.

Immigration holds add another layer to the case

Jail records also indicate that both Santos-Funes and Valladares are subject to immigration holds issued by U.S. Immigration and Customs Enforcement.

Authorities had not established publicly whether either parent was legally present in the United States. An immigration hold is separate from the criminal charges and does not, by itself, determine the outcome of the criminal case.

The criminal proceedings and any immigration-related action are distinct processes, each governed by its own requirements.

    Investigation leaves important questions unanswered

Several details remain unclear, including what initially caused the reported disturbance inside the home, how the extensive property damage occurred and what evidence investigators have gathered beyond the responding officers’ observations.

The allegations also raise questions about the children’s living conditions and what steps authorities may take to ensure their safety while the case proceeds.

When police respond to a child-welfare concern, the immediate priority is to determine whether children face an ongoing danger. Depending on the findings, child-protection authorities may assess the home environment and consider whether additional safeguards are necessary.

The publicly described affidavit does not provide a complete account of any subsequent child-welfare arrangements.

For now, the case centers on the officers’ account of a disturbing scene, the alleged confrontation during the arrest and the four children identified in the charges.

The next court appearance, scheduled for Nov. 13, is expected to be another step in determining how the criminal case will move forward. Until the allegations are addressed in court, the accusations against both parents remain allegations rather than established findings of guilt.
